The U.S employer must meet all the following requirements to be eligible for the J-1 program:
- Active business license
- Adequate infrastructure compliant with the State to support the training
- At least one year of continuous operation (or a track record in the industry), or a subsidiary supported by a holding company
- Sufficient resources (financial, equipment, and trained personnel) to support the training
We will verify that the host company meets J-1 program requirements, including stability, a dedicated workspace, and qualified supervision, to ensure a successful J-1 program.
The training should be in one of those occupational categories:
- Arts and Culture
- Hospitality and Tourism
- Management, Business, Commerce, and Finance
- The Sciences, Engineering, Architecture, Mathematics, and Industrial Occupations
Trainees cannot work in positions that require or involve childcare or elder care, or in any kind of position that involves patient care or contact.
The training should enhance the participant’s skills and expertise in their academic or occupational field. It means:
- The training cannot duplicate a participant’s prior work experience or training,
- And it cannot involve unskilled or casual labor positions, or those that require more than 20 percent clerical or office support work.
The training should be full-time (minimum of 32 hours a week), on-site (no more than 40% remote), and supervised.
The participant must meet one of the following requirements to be eligible for the J-1 program:
- The participant is enrolled at a non-U.S. higher education institution,
- and will complete training in the United States in the same field as their area of study with their host company.
OR
- The participant has graduated from a non-U.S. higher education institution within the past 12 months,
- and will complete training in the United States in the same field as their area of study with their host company.
The participant must meet one of the following requirements to be eligible for the J-1 program:
- The participant has graduated from a non-U.S. higher education institution,
- has at least 1 year of full-time experience outside the U.S.A.,
- and will complete training in the United States in the same field as their experience and area of study with their host company.
OR
- The participant has at least 5 years of full-time experience outside the U.S.A.,
- and will complete training in the United States in the same field as their experience with their host company.
